Investigating a cheating spouse is a delicate matter. Several important factors need to be considered before hand to help increase the odds of getting the proof you are seeking and to ensure that what the investigator finds is going to meet your needs.

Big Decision: If you need to confirm suspicions about a cheating spouse or you already know what they are up to but need some independent evidence, we can help. One of the most important things to do is make the following decision ahead of time:

Do I simply want to know what he/she is doing for peace of mind or am I looking for evidence of infidelity to get an advantage in court?

This is very important for the simple reason that time is money. Our agency, like nearly all others, charge by the hour. If you are trying to establish infidelity and prove fault on the part of your spouse for purposes of gaining an advantage in a divorce action, more time, documentation and investigative work will be required. This will always involve preparing a very detailed report, making proper identification of the other person and likely conducting multiple days of surveillance demonstrating this behavior to show a pattern or get the footage that proves they are more than just "friends".

Fault in a Divorce Action: You should understand that each state has different rules concerning fault and distribution of assets based on same. If the courts in your state have the latitude to give one party more assets and/or alimony if fault (like a spouse cheating) is found, the reality is that infidelity is very common these days and some judges are reluctant to move away from a 50/50 split, despite proof of fault. An analysis of how this may effect your situation should be prepared by your attorney. Each state has varying laws about fault and its effect on judgments, so again consult with an attorney. If you are looking to use spousal surveillance to gain an advantage in court, more often than not, multiple days of surveillance will be required to show a pattern of cheating.

"I Just Want to Know the Truth". For those of you looking for proof but not evidence for court, the surveillance can be easier and cheaper. Why? If your spouse tells you he/she is going to a co-workers retirement party after work but they actually drive to someone's condo and let themselves in, you probably have all the information you need. A judge might need to see a bit more. Again, time is money and the more that you can narrow down "when", "where" and with "whom" your spouse is engaged in this type of behavior, the cheaper, easier and more productive the surveillance will be.

Expectations: Another thing that we recommend is that you keep your expectations in the real world and not in Hollywood. For every case that a private investigator gets videotape of two people being intimate at a motel or in a car, we have another where we can only follow a spouse to some place like a large apartment building where they disappear out of sight in some common hallway. For some, this may be enough, but for others who need more information we may need to conduct additional surveillance and investigative procedures to get more information about where he/she is going or whom they are with. Although this can be frustrating, it is sometimes unavoidable. Other times, your spouse may simply do whatever they said they were going to do: go to the mall, meet a friend for dinner, visit a relative. Being Discreet: Although you may not think that your cheating spouse would ever suspect that someone would be watching them, the majority of cheaters are well aware of the potential for someone, likely you, to be watching them. Cheating feels risky and exciting and watching over your shoulder is part of what all cheaters seem to do. Other times, the cheater is involved with someone else who is cheating making matters worse. Timing: Although your spouse or significant other may spontaneously leave the house, likely meet the other person, all private investigators have multiple clients and lives outside of work. Sometimes our investigators will have another matter scheduled at that moment and we may not be able to initiate surveillance at extremely short notice. You have our promise that if it is possible, we will be there for you, but also try and understand if we cannot be available 24 hours a day.

Evidence: Today, almost all investigators utilize video cameras to capture evidence. The days where an investigator\'s word was all you needed are gone. Videotape is more effective and does not lie. Make sure the investigator you work with has the proper equipment to capture evidence both from a car and inside a hotel, restaurant, bar or other public domain. Hidden, body worn cameras are a must are standard equipment for all of our investigators. If you are going to be involved in a divorce, understand that your investigator may need to testify about the video and the surveillance. Expect that he or she will charge you for their time in court. This is normal for experts.

About domestic surveillance?

Surveillance is the method used to discover if spouses are cheating on each other. It can involve husbands, wives, boyfriends or girlfriends. Also referred to as "tailing someone" it is the technique of putting an investigator out in the field who follows the suspected cheater to document their activities without their knowledge. This is accomplished by recording their activities on videotape.
I’m embarrassed about even talking to someone about this. We regularly get calls from people who suspect their spouse or significant others of infidelity. It is nothing to be embarrassed about. What you are seeking is peace of mind about something you are not sure of. It is natural to seek to determine if your suspicions are real or imagined. We invest a tremendous part of ourselves in relationships. It is natural to want to determine the strength and integrity of that relationship.

What if I am wrong?

If there is no evidence the subject is cheating, you will have gained peace of mind about your relationship. Since our investigations are 100% confidential, you will not have risked sacrificing the relationship if you are wrong.

Is domestic surveillance legal?

Surveillance is the process of documenting what is going on in the world of an individual. As long as we stay with in the law while conducting our investigation (i.e. not trespassing, etc.), surveillance by a licensed detective is completely legal.

What are the fees charged for domestic surveillance?

Surveillance is billed on an hourly basis plus a mileage charge. Rates are dependant on where the surveillance will take place. As a general rule, in remote areas, the rates are a bit higher. Before the case is started, a strategy is established depending on the circumstances and your needs. Once this plan is in place a budget can be established. Investigation services are payable in advance of the work being conducted. Payment can be made by credit card (over the phone if you wish), or by cash, check or money order.

How is the surveillance plan established?

Planning is often more important than execution. The better job we do of designing the surveillance, the more likely it is to be productive and the more cost effective it will be. Because you know more about your spouses behavior than we ever will, we rely on you to assist us in developing the correct time and place to watch them. We need you to determine when they are most likely to be engaged in this behavior and where we should start the surveillance. If you are not able to discern when with any degree or accuracy, we recommend that you consider when they are not available and we can eliminate those times as a starting point. All these questions and more go into creating an effective surveillance strategy.
 

How many investigators are used on a domestic surveillance case?
 

The number of agents used depends on a number of factors. Basic surveillance on an individual being followed from home or an uncomplicated work situation can be conducted by one agent. More complicated scenarios, such as following someone from a high rise office building, or airport or hotel require an additional agent. Other factors in which we may recommend a second agent include fast and aggressive drivers and extra alert drivers who always watch the rear view mirror. Of course an additional agent increases the cost of surveillance, and this factor is also taken into consideration in arriving at your budget. For a proper frame of reference, consider the fact that no law enforcement agency would ever conduct surveillance with less than two cars and few do that. The more investigators, the less likely the chance of detection.
 

What do I do once the spousal surveillance is set up?
 

Once the surveillance plan is in place it is important that you do not do anything to alert the subject of the investigation. Do not change your habits and do not ask too many questions about their activities.
 

How do you follow someone?
 

The techniques of tailing someone are an acquired skill. When following someone we are constantly weighing two factors against each other. First we want to stay close enough to make sure we do not loose the subject at a traffic light or in heavy traffic. However we are constantly balancing this against staying so close that we run the risk of being observed by the subject. The art of balancing these two factors in a variety of situations can only be executed well by having an experienced investigator work on the case. In some cases a second agent is preferable or required which allows us to keep safer distances while not minimizing the chance of loosing the subject. Sometimes we use GPS tracking devices to track the vehicle from a distance.
 

Will the suspected cheating spouse find out that they are being watched?
 

Our surveillance investigations are 100% confidential. We do everything necessary to insure the covert nature of the investigation. If we ever perceive that the security of the investigation is threatened, we back off and re-evaluate with your input. One important point: Never threaten to hire an investigator. This will make the suspected cheater even more difficult to watch. If you have done this, be sure to tell us ahead of time so we can prepare.
 

What evidence will I receive at the conclusion?
 

The evidence collected in domestic surveillance consists of the videotape and or pictures of the activities and a surveillance report which details all the activity in writing. Both are submitted to you, or if you wish we can maintain them for you.
